PRAYER: Petition filed under Section 482 of Code of Criminal Procedure, to direct the Inspector of Police, District Crime Branch, Thoothukudi to take effective steps immediately to seize the cheated money from the custody of the accused persons and also prevent them from flee away from the country involved in Crime No.24/2018 pending investigation on the file of the respondent within time frame as may be fixed by this Court.

This Criminal Original Petition is filed seeking direction to the respondent herein to seize the money which was involved in the offence.
2.When the matter is taken up for hearing, the learned Additional Public Prosecutor would submit that since the entire transaction took place within the jurisdiction of Chennai, a request has been made on 23.02.2019, by the Superintendent of Police, Tuticorin to transfer the investigation in Crime No.24 of 2018 to CCB, Chennai for further investigation. In pursuant to the above request, DIG, Tirunelveli has also forwarded the request to DIG, Chennai and DIG, Chennai has passed an order dated 07.05.2019, on the point of jurisdiction, further investigation was ordered to be taken by CCB, Chennai City, by order dated 07.05.2019. The learned Additional Public Prosecutor would submit that in pursuance to the above said letter, entire file has been transferred to CCB, Chennai and a letter was also sent to the Judicial Magistrate No.I, Alanthur, informing about the transfer of investigation. Information was also given to the son of the petitioner, namely, Karuthapandi in this regard on 09.04.2019.
3.Since the matter has been transferred to CCB, Chennai, the petitioner has to work out his remedy before the concerned https://hcservices.ecourts.gov.in/hcservices/ 1/2
Crl.O.P(MD)No.3349 of 2019 Court. The petitioner's counsel can get the papers from the office of the Additional Public Prosecutor.
4.With the above direction, this Criminal Original Petition is disposed of.
