PRAYER: Writ Petition filed under Article 226 of the Constitution of India, for issuance of Writ of Mandamus, directing the Respondents to take immediate and appropriate departmental action against the convicted public servants, namely A3-Smt.M.Vanitha (BT English), A8-Smt.S.Sridevi (BEO of Theni), and A9-Smt.R.Helan Mettilda (BEO of Cumbum), by dismissing them from service in accordance with the Tamil Nadu Civil Services (Discipline and Appeal) Rules and as well as on the basis of the Principal Secretary to the Government in Letter (MS) No.91/N/2012-1 dated 19-06-2012, following their conviction in C.C.No.66 of 2022 by the Learned Judicial Magistrate, Andipatti, dated 19-02-2026, on the basis of the petitioner's representation dated 22.02.2026, within a time stipulated by this Court. Heard Mr.P.M.Vishnuvarthanan for the Petitioner, Mrs.K.Porkodi, learned Government Pleader for Respondents 1 to 3, Mr.E.V.N.Siva, for Respondents 4 and 5 and Mr.V.Panneer Selvam for the 6th Respondent. 2/6

2. This Writ Petition has been filed for issuance of Writ of Mandamus, directing the Respondents to take immediate and appropriate departmental action against the convicted public servants, namely A3Smt.M.Vanitha (BT English), A8-Smt.S.Sridevi (BEO of Theni), and A9-Smt.R.Helan Mettilda (BEO of Cumbum), by dismissing them from service in accordance with the Tamil Nadu Civil Services (Discipline and Appeal) Rules and as well as on the basis of the Principal Secretary to the Government in Letter (MS) No.91/N/2012-1 dated 19-06-2012, following their conviction in C.C.No.66 of 2022 by the Learned Judicial Magistrate, Andipatti, dated 19-02-2026, on the basis of the petitioner's representation dated 22.02.2026.

The learned Government Pleader appearing for respondents 1 to 3, on instructions, submits that appropriate action has already been initiated, show cause notices have been issued, and explanations have also been submitted by the private respondents 4 to 6 and appropriate orders would be passed after duly considering the said explanations. 3/6

4. In the light of the above statement made by the learned Government Pleader, further adjudication of the matter on merits is not necessary in the present Writ Petition, as the respondents themselves have already initiated action as sought by the petitioner.

5. In view of the above, this Writ Petition is disposed of with a direction to respondents 1 and 2 to pass appropriate orders pursuant to the show cause notice already issued to respondents 4 to 6, within a period of six weeks from the date of receipt of a copy of this order, in accordance with law.

There shall be no order as to costs.
