Heard Mr. K. Muthumalai, learned counsel for the petitioner, and Mr. S. Deenadhayalan, learned counsel appearing for the respondents.
2. The petitioner has approached this Court seeking issuance of a Writ of Mandamus directing the respondents to consider his representation dated 25.02.2026. In the said representation, the petitioner requested the respondents to restore the electricity service connection to his shop, namely, "ARCHUNAN STALL," situated at A. Thekkur Village, Thiruppathur Taluk, Sivagangai District.
3. Mr. S. Deenadhayalan, learned counsel for the respondents, upon instructions, submitted that the petitioner was evicted from the shop for the purpose of widening the Highways and, consequently, the electricity service connection was disconnected. 2/5
4. However, Mr. K. Muthumalai, learned counsel for the petitioner, contended that only the adjacent land was acquired for widening of the Highway and that the land on which the petitioner's shop is situated was not acquired. Therefore, according to him, the disconnection of the electricity service connection is illegal.
5. Since the electricity service connection had been disconnected in the year 2023 and there exists a dispute regarding the eviction of the petitioner, this Writ Petition is disposed of, preserving liberty to the petitioner to submit a fresh online application for providing electricity service connection to the subject property. If such an application is submitted, the respondents are directed to consider the same on its own merits and pass appropriate orders in accordance with law, after inspecting the existence of the shop.
6. The aforesaid exercise shall be completed within a period of four (4) weeks from the date of receipt of the application submitted by the petitioner.
3/5
7. There shall be no order as to costs. Consequently, the connected Miscellaneous Petition is closed.
