This Petition is filed under Article 227 of the Constitution of India against the fair and decreetal order dated 09.08.2017 passed in I.A.No.263 of 2015 in A.S.No.136 of 2015 on the file of the Subordinate Judge, Kuzhithurai.

ORDER

This Civil Revision Petition has been filed by the petitioners, who are the appellants in A.S.No.136 of 2015, challenging the order of dismissal passed in I.A.No. 263 of 2015 in A.S.No. 136 of 2015, on the file of the Sub Court, Kuzhithurai, dated 09.08.2017.

2. Heard the learned counsel appearing for the petitioners as well as the learned counsel appearing for the respondents. https://hcservices.ecourts.gov.in/hcservices/

3. Since the appeal suit is pending from 2015, this Court is inclined to pass the following order:- The learned Subordinate Judge, Kuzithurai, is directed to dispose of A.S.No.136 of 2015, pending on its file, within a period of one month from the date of receipt of a copy of this order, without giving any further adjournment to the parties concerned and the parties are also directed to give their fullest cooperation for early disposal of the above said Appeal Suit. Till the disposal of the Appeal Suit in A.S.No.136 of 2015, the plaintiffs are directed not to proceed with the Execution Proceedings. Further, the learned Appellate Judge, is directed to intimate the disposal of the suit to the Registry, within a period 10 days, after complying with the above said order.

4. With the above directions, the Civil Revision Petition is disposed of. No costs. Consequently, the connected Miscellaneous Petition is closed.
