ORDER

The present Writ Petition has been filed for the issuance of a Writ of Certiorari, to quash the impugned order dated 28.10.2022.

2. Through the impugned order, the second respondent has considered the complaint of the third respondent under Section 83 and concluded that the petitioners had created the documents. As far as the criminal proceedings are concerned, the official respondents have directed to initiate proceeding against the petitioners, and the petitioners are not aggrieved by the same. However, they are aggrieved by the part of the impugned order which permits the third respondent to proceed to deal with the property. Further, the same impugned order restrains the petitioners from dealing with the property.

3. Admittedly, there is a suit in O.S.No.386 of 2023 on the file III Additional District Court, Tirunelveli, filed by the petitioners and the same is ready for trial. In such circumstances, this Court is not inclined to entertain the present writ petition or for granting any restraining order. Therefore, the petitioners are directed to proceed further with the above said suit. The Trial Court is directed to dispose of the suit within a period of six (6) months from the date of receipt of a copy of this order.

4. With the above said directions, this Writ Petition stands dismissed. There shall be no order as to costs.
