ORDER
The petitioner has come forward with the present Writ Petition seeking for issuance of a Writ of Mandamus, directing the first respondent to dispose of her appeal dated 05.02.2018 filed under Section 12 of Tamil Nadu Patta Pass Book Act, within the time stipulated by this Court.
2. Mr.N.Shanmugaselvam, learned Additional Government Pleader, takes notice on behalf of the first and second respondents. In view of the limited order that has to be passed hereunder, issuance of notice to the third respondent is dispensed with. https://hcservices.ecourts.gov.in/hcservices/
3. By consent, the Writ Petition is taken up for final disposal at the stage of admission itself.
4. Aggrieved over the order passed by the Tahsildar in issuing separate patta in the name of the third respondent, the petitioner preferred an appeal to the first respondent. Her appeal dated 05.02.2018 is pending on the file of the first respondent without any consideration. Under Section 12 of Tamil Nadu Patta Pass Book Act, the petitioner preferred the appeal and it has to be disposed of after giving notice to the parties concerned.
5. Considering the limited scope of the prayer sought for by the petitioner in the present Writ Petition, without going into the merits of the case, the first respondent is directed to dispose of the appeal preferred by the petitioner dated 05.02.2018 following the procedures laid down under the Tamil Nadu Patta Pass Book Act, within a period of four months from the date of receipt of a copy of this order.
6. The Writ Petition is disposed of with the above direction. No costs.
