Petition filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Mandamus, directing the second respondent to take appropriate action on the petitioner representation dated 15.04.2021 to prevent the 3rd respondent from harassing for the money received by his father. ORDER

This Writ Petition has been filed to direct the second respondent to take appropriate action on the petitioner representation dated 15.04.2021 to prevent the 3rd respondent from harassing for the money received by his father.

2. The case of the petitioner is that due to financial crunch, the petitioner has obtained some loan from the third parties including the third respondent. Thereafter, he had issued cheques for repayment. But, the third respondent is continuously harassing the petitioner and his mother, demanding repayment of money. Therefore, he made a representation on 15.04.2021 to the second respondent. But, the second respondent has not taken any action against the third respondent. Hence, the petitioner has filed this petition.

3. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent Nos.1 and 2.

4. The learned Additional Public Prosecutor submitted that no complaint has been received so far by the second respondent. 5.Recording the submission made by the learned Additional Public Prosecutor, the writ petition is disposed of with a direction to the petitioner to make a fresh complaint to the second respondent/Police, if any necessary arises. No costs.
