ORDER : The Court made the following order :- This Criminal Original Petition has been filed by the petitioner on 03.04.2025 under Section 483 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 praying to grant bail.

2. The petitioner/Accused was arrested and remanded to judicial custody on 27.02.2025 for the offences punishable under Section 420 of IPC and Section 66D of IT Act in Crime No.54 of 2024 on the file of the respondent-police.

3. The case of the prosecution is that the petitioner published an advertisement in which he stated that Newzealand work visa is provided within 60 days with the salary of Rs.3,00,000/- through facebook account in the name of Silverline Global Consultant. When the defacto complainant contacted for his son's visa, the petitioner demanded Rs.2,50,000/- as advance payment and the same was transferred from the account of the daughter of the defacto complainant on 28.03.2024. The petitioner gave receipt for the payment, agreement and duplicate order copy to them. However, on 19.05.2024, when the defacto complainant contacted the petitioner to know the status of his son's visa, he informed that visa is under 'ptrh process' and 2/5

due to the same, the defacto complainant's son could not be sent abroad and the defacto complainant demanded his money back, which was refused by the petitioner. Hence, the complaint.

4. It is seen that this Court vide order, dated 15.04.2025 has already granted interim bail to the petitioner and the petitioner has complied with the conditions imposed thereon.

5.Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Criminal Side) appearing for the State and also perused the records.

6.The learned Government Advocate (Criminal Side) would submit that the investigation has been completed and charge sheet has also been filed and the same was taken on file in C.C.No.328 of 2025 on the file of the Judicial Magistrate Court No.II, Kanyakumari District. He would further submit that the petitioner has complied with the conditions imposed by this Court regularly, except two days (ie., on 16.06.2025 & 07.07.2025) 3/5

7.Considering the facts and circumstances of the case and also the fact that the investigation has been completed and charge sheet has also been filed and the petitioner is not having any bad antecedents, this Court is inclined to grant regular bail.

8.Accordingly, interim bail already granted is made absolute. However, the petitioner is directed to appear before the Judicial Magistrate Court No.II, Nagercoil, Kanyakumari District on all hearing dates.
