Prayer in WP(MD). 26199/ 2019 :

Writ Petition is filed under Article 226 of the Constitution of India, praying this Court Directing the respondents to pay 18 percent interest for the belated payment of terminal benefits of P.F, Gratuity, Unavailed Leave Salary and Commutation, payable to the petitioner from the date of his retirement i.e., 30-09-2018 to till the date of actual payment made to him and all other attendant benefits within the stipulated period.

ORDER

The present Contempt Petition has been filed alleging non compliance of the order dated 10.12.2019, made in W.P.(MD)No.26199 of 2019.

2. The learned counsel appearing for the respondents submitted that the interest amount payable to the petitioner was calculated and paid through ECS to the bank account of the petitioner.

3. However, the learned counsel appearing for the petitioner submitted that the petitioner has no objection insofar as the calculation made by the respondent corporation. Insofar as commutation of pension is concerned, the petitioner is disputing the calculation made by the Tamil Nadu State Transport Corporation Employees Pension Fund Trust, as there is a huge difference.

4. The third respondent viz., the Administrator, Tamil Nadu State Transport Corporation Employees Pension Fund Trust, is directed to furnish the calculation to the petitioner. If the petitioner is aggrieved, it is open to the petitioner to challenge the same.

5. With the above observation, this Contempt Petition is closed.
