PETITION FOR BAIL Under Sec.439 of Cr.P.C PRAYER :- For Bail in Crime No.NCB.F.No.NCB.F.No.48/1/01/2020/NCB/MDU on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner /A5, who was arrested and remanded to judicial custody on 12.02.2020 for the offence under Section 20(b)(ii)(C), 25, 28, 29 of the Narcotic Drugs & Psychotropic Substances Act, 1985 in Crime No.NCB.F.No.48/1/01/2020/NCB/MDU on the file of the respondent police seeks bail.

2. The case of the prosecution is that on 12.02.2020, based upon the alleged secret information, the NCB officials had intercepted a vehicle, which was occupied by five persons and recovered 661 kds of ganja, which was transferred from Andhra Pradesh to Thanjavur District. Hence, the case.

3. Heard both sides and perused the materials available in the record.

4. It is seen that it is second petition for bail and the first petition was dismissed on 12.10.2020. There is no change in circumstances. Further, final report filed in the year 2020 in https://www.mhc.tn.gov.in/judis 1/2

CRL OP(MD)No.6165 of 2023 C.C.No.23 of 2020 before the learned Principal Special Judge for EC & NDPS Act Cases, Thanjavur. Now, the trial commenced and the prosecution already examined 4 witnesses. Therefore, this Court is not inclined to grant bail to the petitioner. Accordingly, this criminal original petition is dismissed. The trial Court is directed to complete the trial within a period of three months from the date of receipt of a copy of this order.
