ORDER

Seeking to direct the respondents 1 and 2 to conduct enquiry and take appropriate criminal action pursuant to CSR No.1207 of 2024 on the file of the second respondent by considering the petitioner's complaint dated 08.10.2024, this writ petition is filed. 2.It is the case of the petitioner that due to certain dispute, the petitioner got separated from her husband and also filed HMOP.No.618 of 2024 on the file of the Family Court, Madurai. Meanwhile, she tried to get her sridhana property, however, her husband refused to give them back. In this regard, the petitioner had made a complaint before the second respondent police and in this regard, CSR No.1207 of 2024 was assigned. However, so far, there is progress made in the complaint. Hence, the petitioner is before this Court.

3.The learned Government Advocate(Crl.side) submitted that on receipt of the petitioner's complaint, CSR was assigned and after completion of enquiry, the same was closed. He further submitted that as 2/5

per the instructions HMOP filed by the petitioner has been concluded granting decree of divorce.

4.Heard either side and carefully perused the materials available on record.

5.Though it is claimed that HMOP filed by the petitioner had concluded by grant of decree of divorce, considering the submission of the learned counsel for the petitioner that the petitioner's valuables are still with her husband, the second respondent police is directed to reopen the case in CSR.No.1207 of 2024 and conduct enquiry on issuance of notice to the parties under Section 64 of BNSS and conclude the same, within a period of four weeks from the date of receipt of a copy of this order. The petitioner is also directed to appear before the second respondent police for enquiry along with all the necessary documents, including HMOP decree and other details to substantiate her case. 3/5
