Petition filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Mandamus, directing the respondents to consider my application for renewal dated 01.09.2020 and renew my license for the year 2020- 2021. Mr.P.Thilak Kumar, learned Standing Counsel for the Government, accepts notice on behalf of the respondents.
2. By consent, the writ petition is taken up for final disposal at the admission stage itself.
3. According to the learned counsel for the petitioner, the petitioner belongs to State Level Class 1 Contractor(HW) category. The petitioner herein has filed a public interest litigation in W.P. (MD) No.3480 of 2018 for e-bidding to tackle corruption and tender transparency and the Hon'ble Division Bench of this Court had disposed the writ petition on 16.10.2020 with an observation to implement and continue e-bidding. The respondents, immediately on 1/3
22.10.2020 had put the petitioner on black list without assigning any reasons. The petitioner made an application for renewal dated 01.09.2020. Till date, the respondents have not considered the application of the petitioner and therefore, the petitioner has approached this Court by way of filing the present writ petition.
4. The learned counsel for the petitioner would state that it would be suffice if a direction is given to dispose of the representation of the petitioner.
5. The learned Standing Counsel for the respondents would state that the representation of the petitioner would be considered within a reasonable time.
6. Though the petitioner has come forward with a larger prayer, considering the limited prayer now made by the petitioner before this Court as per the submission of the learned counsel for the petitioner, this Court, without going into the merits of the representation, is constrained to direct the respondents to consider the application for renewal submitted by the petitioner dated 01.09.2020 and pass orders on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order.
7. With the above direction, the writ petition is disposed of. However, there shall be no order as to costs.
