To suspend the execution of sentence by granting bail in SC No.50/2016 on the file of the V Additional District and Sessions Court, Madurai District and set aside the judgement dated 01.08.2025 pending disposal of the above Criminal Appeal

ORDER

(Order of the Court was made by the Hon'ble N.Anand Venkatesh J.) This petition has been filed by the petitioner seeking for suspension of the sentence imposed in the judgment made in SC No.50/2016 on the file of the V Additional District and Sessions Court, Madurai District and set aside the judgement dated 01.08.2025 and to enlarge the petitioner on bail.

2. Heard the learned counsel on either side.

3. This is the second petition filed by the petitioner seeking for suspension of sentence. The earlier petition filed in Crl.M.P.(MD).No. 19129 of 2025 came to be dismissed by an order dated 05.01.2026 as withdrawn. However, on going through the order, it is seen that the Court was not inclined to grant suspension of sentence and at that point of time, the petition was withdrawn. In view of the same, the same has to be construed as dismissed on merits.

4. Since we do not find any change in circumstances, we are not inclined to entertain this petition and accordingly, this petition stands dismissed.
