Criminal Original Petition filed under section 482 of Criminal Procedure Code, to transfer the investigation in Crime No.1061 of 2018 dated 08.12.2018 from the 3rd respondent police to the 4th respondent C.B.C.I.D.

O R D E R

This petition has been filed to transfer the investigation in Crime No.1061 of 2018 from the file of the third respondent to the file of the 4th respondent.

2. The learned Government Advocate (Crl.side) appearing for the respondent Nos.1 to 4 submitted that the case was registered in Crime No.1061 of 2018 for the offences under Sections 406, 420, 294 (b), 506(i) of IPC., as against seven accused persons, in which, so far, three accused persons were arrested. He further submitted that almost entire investigation is completed and about to file a final report. Therefore, at this stage, if the investigation is transferred to any other agency, the entire investigation would be affected.

3. Considering the above facts and circumstances of the case, the transfer of investigation cannot be considered. However, the third respondent is directed to file a final report within a period of eight weeks from the date of receipt of a copy of this order. The second respondent shall ensure that the third respondent shall complete the investigation and file a final report within a time framed by this Court.

4. With the above direction, this criminal original petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
