O R D E R

This petition has been filed seeking to direct the respondents 1 and 2 to measure the petitioner's land and fix the four boundaries in S.F.No.124/6B to an extent of 0.52.00 hectares situated in Sirukoodalpatti Village, Thiruppathur, Sivagangai District, and to direct the 3rd respondent to give the police protection based on the petitioner's representation dated 26.07.2025 within a stipulated time in accordance with law.

2. The learned counsel for the petitioner submitted that the petitioner's mother is the owner of the property. Subsequently, she executed a registered gift settlement deed in favour of the petitioner, bearing Document No. 2754 of 2025 dated 25.06.2025, and the patta has also been transferred to the petitioner's name. It was further submitted that the fourth respondent has encroached upon the petitioner's land and removed sand from the said property. Aggrieved by this, the petitioner lodged a complaint before the third respondent, which was registered as CSR No. 176 of 2025. Therefore, the petitioner has applied for measurement of the property and for fixing the boundaries, and has paid the requisite fee.

3. Heard the learned Government Advocate appearing for respondents 1 and 2 and the learned Government Advocate appearing for the 3rd respondent.

Considering the facts and circumstances of the case, this Court directs the 1st respondent to conduct the survey and fix the four boundaries with the assistance of the second respondent after issuing notice to the petitioner as well as the 4th respondent. If necessary, seek police protection, the 3rd respondent shall 3/6

provide police protection to survey the land. The Court is also directing the Official respondents to adhere to the following Standard Operating Procedures: a. The Official respondents shall issue notice to the petitioner immediately reaching the spot where survey is to be conducted. The petitioner shall affix the signature by receiving the notice of survey.

b. After survey again the petitioner shall affix signature indicating that the survey was conducted to their satisfaction.

c. If the petitioner is not satisfied, then also the petitioner shall affix signature indicating their dissatisfaction or with protest. The petitioner shall indicate that reason of their dissatisfaction or protest. The aforesaid procedure shall be strictly followed by the parties The said exercise shall be completed within a period of 12 weeks from the date of receipt of a copy of this order.
