Side) in both petitions PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner in Crl.O.P(MD).No. 9984 of 2018 apprehending arrest at the hands of the respondent police for the offences punishable under Sections 294(b), 324 and 506(ii) I.P.C., in Crime No.121 of 2018, seeks anticipatory bail.

2.The petitioner in Crl.O.P(MD).No.9986 of 2018 apprehending arrest at the hands of the respondent police for the offences punishable under Sections 341, 294(b), 307, 324 and 506(ii) I.P.C in Crime No.120 of 2018, seeks anticipatory bail. 3.Heard the learned counsel for the petitioner and the learned Government Advocate(Crl.Side) for the respondent.

4. It is seen that the quarrel had taken place between the accused and the defacto complainant in connection with temple festival. The defacto complainant was injured. It is submitted that the petitioner only accompanied the principal accused who caused cut https://hcservices.ecourts.gov.in/hcservices/

injury to the defacto complainant.

5.Taking note of the facts and circumstances, the learned counsel for the petitioner, on instruction of the petitioner, undertook to deposit a sum of Rs.7,500/- (Rupees seven thousand and five hundred only) in each Criminal Original Petition to the credit of both the crime numbers before the Jurisdictional Magistrate. The respondent is directed to intimate the defacto complainant about such deposit. It is open to the defacto complainant to withdraw the said amount. Subject to this condition, this Court is inclined to grant anticipatory bail to the petitioner in both petitions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, Alankulam and on his executing a bond for a sum of Rs.

10,000/- (Rupees Ten Thousand only), each with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously.

6.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
