"The petitioners have filed a petition under section 311 Cr.P.C recalling the witnesses of P.W.1 to P.W.3 for the purpose of cross examination and the same was dismissed by observing that there was a delay of eight years in recalling the witnesses.

However, the learned counsel for the petitioner would submit that the delay occurred due to the transfer of case from the Judicial Magistrate, Andipatti to the Judicial Magistrate, Theni.
