High Court's Order dated 08/11/2021 in CRL OP (MD).No.4394 of 2019 The Hon'ble High Court, while hearing the Crl OP(MD) No.4394 of 2019 on 08.11.2021 passed an order as below:

This petition is filed seeking transfer of investigation in Crime No.459 of 2016, pending on the file of the second respondent to some other agency.

2.Now the grievance of the petitioner is that after much efforts and filing of Contempt Petition, final report has been prepared in Crime No.459 of 2016. But, it was prepared by omitting some of the accused persons as well as the offences. It is also stated that since the main accused, namely, Kosalairaman is the police officer, his name has been deleted from the final report. 3.The learned Additional Public Prosecutor would submit that since final report was filed before the Additional Mahila Court, Trichy and the same was taken cognizance in CC No.77 of 2018 and after appearance of the accused, summons was issued to PW 1 on 05.04.2019.

4.The learned counsel for the petitioner would submit that after filing of this petition, final report has been filed before the concerned Court. But it appears that CC Number has been mentioned in the petition itself.

Court, Trichy as to the stage of the case.
