O R D E R

The Learned Government Advocate (Crl.side) produces an Office Memorandum in Reference No.PE10/2016/POL/TK dated 07.01.2016 and informs this Court that one Mr.Mathialagan, Inspector of Police, V & AC, Tuticorin was requested to register and conduct a Preliminary Enquiry against Mr.Thangavijayakumar, Inspector of Police, Yettaiyapuram Police Station, Thoothukudi District and submit the Preliminary Enquiry Report within 15 days.

2. At this stage, this Court pertinently points out that the Petitioner in Crl.O.P.(MD).No.315 of 2016 has sought for passing of an order by this Court in directing the Second Respondent/Deputy Superintendent of Police, V&AC, Tuticorin to register a case on his complaint dated 21.12.2015 and proceed with the same as per Law.

In view of the fact that one Mathialagan, Inspector of Police, V& AC, Tuticorin was requested to register and conduct a Preliminary Enquiry as seen from the Memorandum in Reference No.PE10/2016/POL/TK dated 07.01.2016, this Court opines that nothing survives for adjudication in the present Criminal Original Petition filed by the Petitioner for the present and viewed in that perspective, the Criminal Original Petition is closed.
