..Respondent PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondent to permit the petitioner's mini bus bearing Registration No.TN 74 E 7817 as per the Transport Commissioner's circular letter in R.No.90919/E2/2000, dated 29.11.2000, while ply on the route AA Naas Chappal shop to Mathiyas Nagar forthwith.

ORDER

This Writ Petition has been filed by T.Ramakrishnan, seeking a limited prayer to direct the respondent to permit their mini bus bearing Registration No.TN 74 E 7817 as per the Transport Commissioner's circular letter in R.No.90919/E2/2000, dated 29.11.2000, while ply on the route AA Naas Chappal shop to Mathiyas Nagar forthwith.

While plying the petitioner's mini bus on the road AA Naas Chappal shop to Mathiyas Nagar on the basis of a letter in R.No.90919/E2/2000, dated 29.11.2000 in the light of the order passed by this Court in a Writ Petition in W.P.(MD)No.12257 of 2011 in R.Barathi Vs. Regional Transport Authority, Dindigul vide order dated 29.10.2011, this Court has held as follows:

"5.Under the circumstances, this Court is also inclined to follow the same order by directing the respondent to permit the petitioner's mini bus bearing registration No.TN-57/AZ9570 to go inside the Palani Bus stand, as per the Transport Commissioner's Circular letter in R.No.90919/E2/2009, dated 29.11.2000, while operating on the route, "THIRUAVINANKUDI THENKARAI TO SENGALSOOLAI" to https://hcservices.ecourts.gov.in/hcservices/

the condition that the Writ petition is allowed subject to the condition that the petitioner complies with condition No.1 found incorporated in the letter mentioned above issued by the Transport Commissioner of Tamil Nadu. No costs."

3. Mr.R.Velmurugan, learned Government Advocate takes notice for the respondent.

4. In an identical circumstances, this Court has passed the above order in W.P.(MD)No.12257 of 2011. Following the same, the respondent is hereby directed to permit the petitioner's mini bus bearing bearing Registration No.TN 74 E 7817 as per the Transport Commissioner's circular letter in R.No.90919/E2/2000, dated 29.11.2000, while ply on the route AA Naas Chappal shop to Mathiyas Nagar forthwith.
