O R D E R

The petition has been filed by the petitioner to quash the rejection order in Na.Ka.No.27/Ka.Thu.Ka.Thiruvai/2025, dated 11.03.2025 passed by the second respondent and consequently direct the respondents to grant permission to conduct Kabadi Tournament scheduled to be held on 29.03.2025 at 7.00 p.m. to 30.03.2025 at 10.00 p.m. on account of the birth day of "Hon'ble Chief Minister of Tamil Nadu M.K.Stalin" at public ground, Vitilapuram Village, Srivaikundam Taluk, Thoothukudi District.

2. The learned counsel for the petitioner would submit that the petitioner is the member of the Kabadi kuzhu, Vitilapuram Village and they decided to conduct Kabadi Tournament on account of the birthday of the Hon'ble Chief Minister of Tamil Nadu and thereby, they approached Page No. 2 of 6

the third respondent for conducting Kabadi tournament from 29.03.2025 to 30.03.2025, but the same was rejected by the second respondent through order Na.Ka.No.27/Ka.Thu.Ka.Thiruvai/2025, dated 11.03.2025 by stating the reason that already there is a communal clash between two community groups and if the tournament is permitted to be conducted, there is a chance for communal clash. Therefore, they rejected the representation. In fact, in this Kabadi tournament, there cannot be any communal clash between two groups. The Kabadi players are only going to play Kabadi and the Kabadi is one of the sports activity. Therefore, only for the reasons of law and order issue, the permission cannot be declined. Therefore, the order passed by the second respondent is liable to be quashed.

The learned Additional Public Prosecutor for the respondents 1 to 3 would submit that the petitioner sent a representation, dated 10.03.2025 and the same was considered and also the permission was declined since already there is a communal clash between two community groups and a case in Crime No.118 of 2025 was also registered. Therefore, by stating the said reasons, the representation of the petitioner was rejected. Hence, he prays to dismiss this petition.

4. This Court heard both sides and perused the records.

5. According to the petitioner, they decided to conduct Kabadi tournament from 29.03.2025 to 30.03.2025, but the second respondent police declined to grant permission. According to the second respondent police, there is a law and order issue and already a case in Crime No.118 of 2025 was registered and there is a chance for communal clash between two community groups. Therefore, they rejected the same.

On instructions of the petitioner, the learned counsel for the petitioner undertakes to conduct the tournament without any law and order issue and there will not be any communal clash as alleged by the respondent and this is only a sport activity and they will not indulge any crime activity during the tournament. Therefore, recording the abovesaid submission of the learned counsel for the petitioner, this Court is inclined to grant permission to conduct Kabadi Tournament by setting aside the order passed by the second respondent in Na.Ka.No. 27/Ka.Thu.Ka.Thiruvai/2025, dated 11.03.2025.

7. Therefore, the second respondent police is directed to give Page No. 4 of 6

adequate police protection and to moniter the event. If any deviations, the respondents 2 and 3 are at liberty to take appropriate action in accordance with law. The petitioner is also directed to ensure the law and order, without any communal clash.

8. With the above said observations and directions, this Writ Petition is disposed of.
