Respondent PRAYER:- Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the records pertaining to the impugned proceedings in RFL/Annavasal/21/2026, dated 04.03.2026, issued by the respondent and quash the same and consequently, direct the respondent to register the settlement deed dated 04.03.2026 presented by the petitioner, within the time that may be stipulated by this Court without insisting for the production of original parent document.

ORDER

The writ petition is filed challenging the refusal check slip dated 04.03.2026. When the petitioner presented the settlement deed for registration, the same was refused on the ground that the parent deed was not produced by the petitioner.

2. The case of the petitioner is that the parent deed is non-traceable, as it was lost during the renovation of his house. Even so, in view of Section 34-C of the Registration Act, if the document is lost, the petitioner has to produce a nontraceable certificate.

3. Therefore, it is open to the petitioner to approach the jurisdictional Police regarding the missing document. The same shall be dealt with in accordance with the relevant circular and in the manner known to law, and a nontraceable certificate may be issued by the jurisdictional Police as expeditiously as possible.

4. As and when such a certificate is issued, it will be open to the petitioner to re-present the document, upon which it may be registered.
