PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying to direct the respondent no.2 to give a adequate police protection to enable the petitioner to use the personal pathway in survey no.7/1c, for ingress and egress from his another adjacent 50 cents of house site in survey no.8/1Apt, 9/pt situated south to this survey no.7/1c and to give the petitioner and his family members for their life and limb on the basis of the petitioner's representation dated 31.03.2022.

ORDER

This petition has been filed seeking direction to direct the respondent no.2 to give a adequate police protection to enable the petitioner to use the personal pathway in survey no.7/1c, for ingress and egress from his another adjacent 50 cents of house site in survey no.8/1Apt, 9/pt situated south to this survey no.7/1c and to give the petitioner and his family members for their life and limb on the basis of the petitioner's representation dated 31.03.2022.

2. The petitioner owned property in S.No. 7/1C ad-measuring 1666.5 sq.ft which is used as pathway. However it was objected by the fifth respondent and as such the petitioner has lodged complaint and seeks police protection only for pathway to reach the house property. Thus the entire allegations are civil in nature for which police protection cannot be considered.

3. In view of the same, the Criminal Original Petition stands dismissed. However the petitioner is at liberty to approach the civil court for appropriate relief.
