ORDER

This Criminal Original Petition has been filed seeking a direction to the learned Chief Judicial Magistrate, Dindigul, to complete the trial in Spl.C.C.No.01 of 2014 in Crime No.4 of 2009 on the file of the respondent Police within a time to be stipulated by this Court.

2. It is the case of the petitioner that he was appointed as Tester in TANGEDCO, Dindigul Division in the year 1984. Thereafter, in the year 2005, he was promoted as Junior Engineer. According to the petitioner, he rendered unblemished service. While so, on 21.10.2009, a case in Crime No.4 of 2009 was registered against him by the respondent Police alleging that he demanded a sum of Rs.5,000/- as illegal gratification other than the legal remuneration for providing III phase electricity connection to one Nagarajan. Subsequently, he was suspended from his service on 22.10.2009 and his suspension was also revoked on 30.12.2010. A charge sheet has also been filed under Section 13(2) r/w. 13 (1)(d) and 7 of Prevention of Corruption Act 1978 before the Special Court for Trial of Prevention and Corruption Act cases, Madurai, in Special Case No.100 of 2011, which was subsequently transferred to the learned Chief Judicial Magistrate, Dindigul, as Special C.C.No.1 of 2014. Now, it is the grievance of the petitioner that though the case was taken on file in the year 2011 and it was transferred to the file of the learned Chief Judicial Magistrate, Dindigul in the year 2014 itself, the same is pending before the trial Court. Therefore, the present petition has been filed seeking for early disposal of Spl.C.C.No.01 of 2014 pending on the file of the learned Chief Judicial Magistrate, Dindigul

4. Today, when the matter is taken up for hearing, the learned Government Advocate (Crl. Side) representing Mr.K.K.Ramakrishnan, learned Additional Public Prosecutor, submits that on the side of prosecution, all the witnesses have been examined and the case stands posted on 06.08.2020 for questioning the accused under Section 313 Cr.P.C.

5. In view of the submission made by the learned Government Advocate (Crl. Side) that the prosecution has completed the examination of witnesses, the trial Court is directed to complete the trial in Spl.S.C.No.01 of 2014 and dispose of the same within a period of three months from the date of receipt of a copy of this order.

6. With the above direction, the Criminal Original Petition is disposed of.
