This Civil Revision Petition is filed to direct the learned Subordinate Judge, Sivagangai to dispose of the E.A.No.104 of 2015 in EP.No.55 of 2007 in LAOP.No.1 of 1999, on his file.
2. The petitioner filed E.A.No.104 of 2015 for payment of amount as deposited from and out of the award amount, deposited by the respondent. In the said application, the Court below directed the father of the petitioners to withdraw 50% of the award amount together with accrued interest. After death of the father, his legal heirs were impleaded. Thereafter, the learned Judge is not passed any order in Execution Application, but, periodically adjourned the Execution Application without assigning any reason. https://hcservices.ecourts.gov.in/hcservices/
3. In the circumstances, the petitioner has come out with the present Civil Revision Petition for speedy disposal of the Execution Application.
4. I have heard the learned counsel appearing for the parties and perused the materials available on record.
5. Taking into consideration of the material facts and circumstances, this Court is of the view that in the interest of justice, it may be expedient to issue a direction to the learned Subordinate Judge, Sivagangai. Accordingly, this Civil Revision Petition is allowed and the learned Subordinate Judge, Sivagangai is directed to dispose of E.A.No.104 of 2015 in EP.No.55 of 2007 in LAOP.No.1 of 1999, as expeditiously as possible, in any event, not later than 30th April 2017. No costs.
