PRAYER: Civil Revision Petition is filed, under Article 227 of the Constitution of India, to direct the learned Subordinate Judge, Ramanathapuram, to dispose of the O.S.No.42 of 2014 as expeditiously as possible.

The petitioner has filed this Civil Revision Petition to direct the learned Subordinate Judge, Ramanathapuram, to dispose of the O.S.No.42 of 2014 as expeditiously as possible.

2. The petitioner is the third defendant in O.S.No.42 of 2014 on the file of the learend Subordinate Judge, Ramanathapuram,. The first respondent who is the plaintiff filed suit in O.S.No.42 of 2014 for partition. According to the petitioner, in the suit proceedings the written statement filed; issues were framed; plaintiff side evidence adduced and closed; the defendant has filed his proof affidavit and for cross examination of the DW.1, it is posted for trial and thereafter, the suit is being adjourned frequently.

3. In the circumstances, the petitioner has filed the present revision.

4. I have heard the learned counsel appearing for the

petitioner and perused the materials available on record.

5. Taking into consideration of the material facts and circumstances, this Court is of the view that in the interest of justice, it may be expedient to issue a direction to the learned Subordinate Judge, Ramanathapuram. Accordingly, this Civil Revision Petition is allowed and the learned Subordinate Judge, Ramanathapuram, is directed to dispose of O.S.No.42 of 2014 as expeditiously as possible, in any event, not later than 31st July 2017. No costs.
