ORDER: The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 6(2)(3)(4) of the TNSC (RDCS) Order 1982 r/w. Section 7(1)(a)(ii) of the Essential Commodities Act, 1955, in 1/5

Crime No.60 of 2026, on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner is illegally found possession with 28 bags PDS Rice each containing 50 kilograms. Hence, the above has been registered as against the petitioner for the above alleged offence.

3.The learned counsel appearing for the petitioner submitted that the petitioner has not involved in any such occurrence as alleged in the FIR. There is no ingredients for violation of Controlled Substances Act. He seeks this Court to grant anticipatory bail to the petitioner. 4.The learned Government Advocate (Crl. side) appearing for the respondent he vehemently opposed the grant of anticipatory bail to the petitioner, since the petitioner is possessed with PDS Rice illegally. But, the petitioner has no previous case.

5.Considering the submissions made on the side of the petitioner that there is no ingredient for violation of controlled substance Act and the 2/5

petitioner is having no previous case, this Court is inclined to grant bail to the petitioner on condition. Accordingly, this Criminal Original Petition is allowed on condition that the petitioner shall pay a sum of Rs.20,000/-(Rupees Twenty Thousand Only) as non-refundable fund, to the credit of Account number A/c. 42588794148; IFSC : SBIN0016318; State Bank of India, Ottapidaram Branch and to show the proof for the same before the concerned Judicial Magistrate. 6.On production of receipt / acknowledgement for having paid the amount, the petitioner is ordered to be released on bail in the event of arrest or on his appearance, on condition that the petitioner shall execute a bond for a sum of Rs.10,000/-(Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the Learned Judicial Magistrate No.III, Dindigul, within a period of fifteen days from the date on which the order made ready and on further conditions that:

[a]the petitioner and the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhaar card or bank pass book to ensure their identity. [b]the petitioner shall report before the respondent police daily at 10.30 a.m., for a period of fifteen days and thereafter, as and when required. 3/5

[c]the petitioner shall not tamper with the evidence or witness either during investigation or trial.

[d]the petitioner shall not abscond either during investigation or trial. [e]On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner is released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].

[f]If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of BNS.
