ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 408, 465, 468, 471 and 477 IPC in Crime No.2618 of 2020, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner joined in IFFCO TOKIO General Insurance Company as Senior Executive at Madurai. He collected the amounts to the tune of Rs.17,71,070/- from various customers. Thereafter, those amounts were checked for recollections by the defacto complainant and the defacto complainant found that the petitioner fabricated some of the documents of policies. Thereby, the petitioner misappropriated to the tune of Rs.17,71,070/-. Hence, the complaint.

CRL OP(MD)No.7146 of 2021 3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case.

4.The learned Government Advocate(Crl.side) appearing for the respondent police opposed this petition on the ground that investigation is pending.

5.It is seen that this is third anticipatory bail petition. The earlier anticipatory bail petition in Crl.O.P.(MD)No.13 of 2021 was dismissed on 23.03.2021 by giving reasons for dismissal. There is no change in circumstances since the dismissal of the earlier petition. The amount said to have been misappropriated to the tune of Rs.17,71,070/-, has not been recovered so far and investigating is also pending. In the said circumstances, this Court is not inclined to grant anticipatory bail to the petitioner.
