For Respondent : Mr.S.Ravi, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory bail in Crime No.35 of 2020 on file of the respondent police ORDER : The Court made the following order :- The petitioner, who apprehend arrest by the respondent police for the alleged offence under Sections 420, 294(b) and 506(ii) of IPC, has filed this anticipatory bail petition. 2.The case of the prosecution is that the petitioner and his family members had received a sum of Rs.18,19,500/- (Rupees Eighteen Lakhs, Nineteen Thousand and Five Hundred only) from the defacto complainant promising to get Government Job in Indian Railways and thereby, cheated them. A2 is the son of the A1 and A3 is his wife. 3.

The learned counsel for the petitioner submitted that the petitioner is a painter by profession and he got in touch with two other persons named Anandan and Selvakumar, who informed the petitioner that they can get Government Job. Believing their words, the petitioner introduced certain persons to them and he did not receive any payment and it was directly paid to the said persons. The learned counsel further submitted that without going against the main accused persons, the petitioner and his family members are being targeted by the respondent police.

4.Per contra, the learned Additional Public Prosecutor appearing on behalf of the respondent police submitted that the petitioner has been arrayed as A1 and his wife and son have been arrayed as A2 and A3 respectively. It was submitted that the accused persons had received a sum of Rs.18,19,500/- (Rupees Eighteen Lakhs, Nineteen Thousand and Five Hundred only) from the defacto complainant by promising to get Government Job. It was further brought to the notice of this Court that the anticipatory bail petition filed by the co-accused was dismissed by this Court by an order, dated 21.04.2021, in Crl.O.P.(MD).No.3349 of 2021. 5.In the considered view of this Court, there are serious allegations made against the petitioner and it is a case of Job Racketing. The anticipatory bail petition filed by the co-accused has been dismissed by this Court and therefore, this Court is not inclined to entertain this anticipatory bail petition, since custodial interrogation will be required in this case. 6.In view of the above, this anticipatory bail petition stands dismissed.
