This writ petition has been filed seeking a writ of Mandamus, directing the second respondent to demote the petitioner to the post of Village Administrative Officer from the post of Assistant by considering his reminder representation, dated 24.12.2024

2. The case of the petitioner is that he was initially appointed as Village Administrative Officer on 26.08.2010. He was promoted as Assistant on 13.09.2021. Due to his family situations, he is unable to discharge his duties as Assistant. Accordingly, he gave a representation on 20.05.2023 to the second respondent to demote him and post him as Village Administrative Officer. Against the inaction of the second respondent in considering his representation, he filed this writ petition.

Considering the fact that the prayer sought in this writ petition is only with regard to the non consideration of his representation, dated 20.05.2023, in my considered view, it is appropriate and reasonable to dispose of this writ petition at the stage of admission with the consent of both sides without going into the merits of the case with a direction to the second respondent to consider the representation, dated 20.05.2023 of the petitioner within a time to be stipulated to meet the ends of justice.

4. Accordingly, this writ petition is disposed of with a direction to the second respondent to consider and pass appropriate orders on the representation, dated 20.05.2023 of the petitioner in accordance with law within a period of four weeks from the date of receipt of a copy of this order.
