ORDER
This criminal revision case has been filed to call for the records of the IV Additional District Court, Madurai in Crl.A.No.8 of 2020 dated 24.02.2021 confirmed the judgment passed by the learned Judicial Magistrate No.II, Madurai in S.T.C.No.831 of 2016 dated 29.11.2019. 1/4
2.The matter has been settled between the parties out of the Court. Memo has also been filed by the petitioner to that effect. The learned counsel for the petitioner submitted that compensation of Rs.5,00,000/- has been awarded by the trial Court, which was confirmed by the appellate Court. Therefore, the above said settlement has been reached between the parties with regard to the above said compensation amount. He would further submit that while granting the suspension of sentence, this Court directed the petitioner to deposit a sum of Rs.1,00,000/-(Rupees One Lakh only) to the credit of S.T.C.No.831 of 2016, on the file of the learned Judicial Magistrate No.II, Fast Track Mahila Court(Magistrate Level), Madurai.
3.In view of the settlement arrived by the parties, 5% of the agreed amount was directed to be deposited to the credit of High Court Legal Services Authority, that was also complied by the petitioner. In view of the settlement between the parties, this revision petition is allowed. The judgment and conviction rendered by the Courts below against the petitioner are set aside. The revision petitioner is acquitted from all the charges S.T.C.No.831 of 2016 on the file of the learned Judicial Magistrate No.II, Madurai. Court (Magistrate Level), Madurai is directed to return the amount of Rs.1,00,000/-, which was deposited into the credit of S.T.C.No.831 of 2016 to the respondent/complainant on filing proper application. The joint compromise memo filed by both parties shall form part of the Court records.
