ORDER

The petitioner has filed this Civil Revision Petition, to direct the learned Principal Subordinate Judge, Nagercoil, to dispose of I.A.No.103 of 2016 in HMOP.No.17 of 2016, within the stipulated period of time.

2. The revision petitioner, who is the husband, filed M.C.No.5510 of 2016, under Section 9 of the Hindu Marriage Act, before the Family Court, Bangalore, for restitution of conjugal rights. Subsequently, the respondent wife filed HMOP.No.17 of 2016, under Section 13(1)(i-a) of the Hindu Marriage Act, for divorce and the same is pending before the Sub Court, Nagercoil. The petitioner filed I.A.No.103 of 2016 in HMOP.No.17 of 2016 to permit him to visit his children once in a month. The respondent also filed counter on 01.09.2016 and the said Interlocutory Application was posted for enquiry. Subsequently, the said Interlocutory Application was not taken up for hearing and the same is pending without any progress.

3. In the circumstances, the petitioner has come out with the present revision.

4. I have heard the learned counsel appearing for the petitioner and perused the materials available on record.

Taking into consideration of the material facts and circumstances, this Court is of the view that in the interest of justice, it may be expedient to issue a direction to the the learned Principal Subordinate Judge, Nagercoil. Accordingly, this Civil Revision Petition is allowed and the the learned Principal Subordinate Judge, Nagercoil, is directed to dispose of I.A.No.103 of 2016 in HMOP.No.17 of 2016 as expeditiously as possible, in any event, not later than 30th April 2017. No costs.
