Heard both sides.

2. The petitioner challenges the impugned Form-II notice issued by the 1st respondent. Admittedly, the impugned Form-II notice has not been preceded by any survey.

3. In this view of the matter, the impugned Form-II notice is quashed. The matter is remitted to the file of the respondents. The first respondent shall issue notices to all the interested persons including the writ petitioner and conduct survey. Based on the same, Form-I notice will be issued thereafter. It is for the first respondent to take action as per law. This writ petition stands allowed on these terms. No costs. Consequently, connected miscellaneous petition is closed.
