PRAYER :- For Bail in Crime No. 32 of 2018 on the file of the Respondent Police ORDER : The Court made the following order :- The petitioner herein was arrested and remanded to judicial custody on 12.07.2019 for the alleged offences under Sections 302 and 201 of IPC.

2. There are totally two accused in this case and the petitioner herein is arrayed as A1. Based on the complaint given by the mother of the deceased that her son was found missing, earlier crime was registered for 'Man Missing'. Subsequently the petitioner gave an extra judicial confession before the Village Administrative Officer admitting his guilt, thereafter the case has been altered to Sections 302 and 201 of IPC and the petitioner was arrested on 12.07.2019. The petitioner suspecting the deceased that he is the cause for the death of his 13 pet dogs had attacked the deceased with deadly weapon and screened the evidence by taking the body of the deceased to the river bed and buried. https://hcservices.ecourts.gov.in/hcservices/ 1/2

3. The learned counsel for the petitioner would submit that both the petitioner and the deceased are close friends. He would also submit since he is the friend of the deceased he has been falsely implicated in the above case. He would also submit that the petitioner is in jail for more than one year, hence he may be granted bail.

4. The learned Additional Public Prosecutor would submit that the petitioner herein is a notorious rowdy element and he is involved seven previous cases and criminal cases are also pending against him, out of which three cases are for offence under Section 302 of IPC and other cases for various offences under IPC. The earlier bail petition of the petitioner was dismissed by this Court on 12.03.2020.

5. Considering the fact that the deceased has been murdered in a cruel manner and if the petitioner is released on bail he will tamper the witnesses and indulge in similar type of offences again, this Court is not inclined to grant bail to the petitioner.

6. Hence, the petition stands dismissed.
