This Writ Petition has been filed under Article 226 of the Constitution of India praying for a Writ of Mandamus directing the respondents to survey the petitioner's land situated in Survey No.329/8B in Karaikkal Village, Madurai South, Madurai District to an extent of 15 cents and issue patta by sub-dividing the same. ORDER

This Writ Petition has been filed praying for a Writ of Mandamus directing the respondents to survey the petitioner's land situated in Survey No.329/8B in Karaikkal Village, Madurai South, Madurai District to an extent of 15 cents and issue patta by subdividing the same.

2. Mr.A.Muthukaruppan, learned Additional Government Pleader takes notice for the respondents.

3. By consent, the Writ Petition itself is taken up for final disposal.

4. The case of the petitioner is that the petitioner is residing at Door No.3/288, Virumandi Kovil Street, Nethaji Nagar, Thanakkankulam Village, Madurai South Taluk, Madurai District. https://hcservices.ecourts.gov.in/hcservices/

She had purchased the landed property in Survey No.329/8B in Karaikudi Village, Madurai South Taluk, Madurai District measuring to an extent of 15 cents in the year 2012 for valuable consideration through a registered sale deed dated 11.04.2012 in Document No.781 of 2012, before the Sub-Registrar, Madurai South, Madurai District. From the date of purchase, the petitioner is in possession and enjoyment of the same. While the matter stood thus, the petitioner has made a representation to the second respondent on 27.03.2014 to issue patta, by surveying the land and fix boundaries. But there was no response. Hence, the petitioner made another representation on 21.08.2015. Even thereafter, no steps have been taken by the second respondent to sub-divide the land. Hence, the petitioner has come forward with the present Writ Petition for the above stated relief.

Considering the submissions made by the learned counsel for the petitioner, the petitioner is directed to give a fresh representation to the second respondent along with a copy of this order, within a period of two weeks from the date of receipt of a copy of this order and on receipt of the same, the second respondent is directed to consider the same and pass appropriate orders with regard to survey of the land belongs to the petitioner by affording an opportunity of hearing to all the necessary orders, within a period of four weeks thereafter. With the above direction, the Writ Petition is disposed of. No Costs.
