O R D E R

The petitioner has filed this Civil Revision Petition to direct and take it the return order of Subordinate Judge, Pudukottai in H.M.O.P.SR.No.315/2016, dated 09.01.2017. 2.The petitioner filed H.M.O.P.SR.No.315/2016, against the respondent to cancel the marriage that took place on 15.07.2002 and grant decree of divorce.

3.According to the petitioner, the petitioner and the respondent loved each other and started living together from 15.07.2002 as husband and wife. Two children were born to them in the said relationship. When the petitioner went to abroad for his work, the respondent married one Sathees and living together. Therefore, the petitioner filed H.M.O.P.SR.No.315/2016 for divorce. The learned Judge returned the said HMOP. 4.Against the said return, dated 09.01.2017, the petitioner has come out with the present Civil Revision Petition. 5.From the averments made in the petition filed by the petitioner, it is seen that admittedly, no marriage has been taken place as per provisions of any of the Act. According to the petitioner, both petitioner and respondent were living together as husband and wife.

6.In view of the averments made in the petition, the relief sought for by the petitioner in HMOP is not maintainable. Hence, the Civil Revision Petition is dismissed. No costs. Sd/- Assistant Registrar (CO) /True Copy/ Sub Assistant Registrar am To The Subordinate Judge, Pudukottai.
