PRAYER: Criminal Original Petition is filed under Section 482 of Cr.P.C, directing the respondents to conduct further investigation based on the complaint given by the petitioner along with material evidence dated 20.10.2021 in connection with Crime No.72 of 2000 on the file of the second respondent Police.

connection with Crime No.72 of 2000 on the file of the second respondent Police.

2. The case of the petitioner is that the petitioner's husband, viz., Viswalingam and his brother's son, viz., Veeramuthu were found dead, for which, the second respondent Police registered a case in Crime No.72 of 2022 for the offence under Section 304(A) IPC. Thereafter, the respondent Police closed the said case as "undetected" by stating that they could not found the vehicle involved in the said offence. It is seen that, already, there was previous enmity between the petitioner's husband and one Thambiayya, who is a liquor merchant, lives in Raramuthirakottai. Due to which, the petitioner suspects the said Thambiayya and his henchmen were committed murder of her husband. Therefore, the petitioner gave a complaint on 20.10.2021 against the said Thambiayya before the respondent Police, however, the respondent Police has not taken any steps to conduct the investigation.

3. The learned counsel appearing for the petitioner would submit that this Court may issue a direction to the respondents to consider the complaint given by the petitioner on 20.10.2021. 2/4

4. The learned Government Advocate (Criminal Side) appearing on behalf of the respondent Police would submit that the enquiry has been conducted and the same was closed on 06.11.2021.

5. In view of the above, no further orders are required to be passed in this Criminal Original Petition and the same stands dismissed. Liberty is granted to the petitioner to work out his remedy in the manner known to law.
