Prayer: Writ Petition filed under Article 226 of the Constitution of India to issue a writ of mandamus directing the respondents to consider the petitioner's representation dated 27.01.2023 and to permit the petitioner to continue in the post of Guest Lecturer at the 5th respondent College till the post of Assistant Professors, Librarians are filled up through the direct recruitment at the 5th respondent college in the light of the G.O.(Ms).No.183 dated 15.09.2022 of the Higher Education (G1) Department.

ORDER
The petitioner was engaged as a guest lecturer in the 5th respondent college on 05.09.2019. However, he has been subsequently disengaged from the year 2022 and therefore, the petitioner has submitted a representation on 27.01.2023 to appoint him as a guest lecturer in the said place based on GO.Ms.No.183 Higher Education (G1) Department and has filed this writ petition, dated 15.09.2022. 2/5
2.The 5th respondent Principal of the college has filed a counter affidavit stating that the petitioner was engaged a guest lecturer in the vacant place in the 5th respondent college. By proceedings dated 02.11.2022 of the 2nd respondent one Dr.CVR.Hari Narayanan, Assistant Professor, Government Arts College, Paramakudi, has been posted in the Government Arts and Science College, Thirumangalam. Therefore, the petitioner was returned to the 4th respondent university as per clause 5(vi) of GO.Ms.No.183, Higher Education (G1) Department, dated 15.09.2022. The 4th respondent university has declared the candidature of the petitioner as not fit and the same is also communicated to the 2nd respondent by the 4th respondent university vide letter dated 01.12.2022. The petitioner was engaged only as a guest lecturer in the vacant place in the 5th respondent college. Therefore, the petitioner cannot be engaged as a guest lecturer anymore in the 5th respondent college.
3.Considering the counter affidavit that the petitioner has been engaged only as a temporary guest lecturer this court is not inclined to entertain this writ petition. The learned counsel for the petitioner has 3/5
pointed out that for the services of the petitioner, the salary has not been paid to him from November 2022 to January 2023. Therefore, the 5th respondent shall consider the plea of the petitioner and pay the salary for the said period, if the salary is not paid already. 4.With the above direction, the writ petition is dismissed.
