To set aside the Judgment and Decree passed in A.S.No.48 of 2006 dated 04.09.2019 on the file of the Additional District (Fast Track Court), Nagercoil confirming the Judgment and Decree passed in O.S.No.87 of 2004 dated 01.08.2006 on the file of the Sub Court, Padmanabhapuram, Kanyakumari District and allow the Second Appeal. ORDER : This petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.K.SREEKUMARAN NAIR, Advocate for the petitioners, the court made the following order:- This petition has been filed by the petitioner seeking to condone the delay of 102 days in paying deficit court fee in the above second appeal.
2.Considering the reasons stated in the affidavit filed in support of the petition and considering the length of delay, this Court is inclined to condone the delay subject to the payment of cost of Rs.150/- (Rupees one hundred and fifty only) to the Legal Aid Services Authority, attached to this Bench, within a period of one week from the date of receipt of a copy of this order, failing which, this petition shall stand dismissed automatically without any further reference to this Court.
