PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C., to order to withdraw and transfer the investigation in Crime No.191 of 2015 on the file of the 3rd respondent police to 2nd respondent police for effective investigation.

ORDER

This petition has been filed for a direction to withdraw and transfer the investigation in Crime No.191 of 2015 on the file of the 3rd respondent police to 2nd respondent police for effective investigation.

2. Heard the learned counsel for the petitioner and the learned Government Advocate for the respondents.

3. The respondent police has filed a counter affidavit stating that the investigation is proceeding in proper lines and there are 17 witnesses have been examined in this case.

4. In view of the above, this Court is of the view that it is not a fit case to transfer the investigation. It would suffice the Deputy Superintendent of Police, Kamudhi, is directed to monitor the investigation done by the Inspector of Police, Kamudhi Police Station in Crime No.191 of 2015.

4. This criminal original petition is disposed of with the above direction.
