Prayer : Criminal Original Petition filed under Section 482 Cr.P.C., to direct the third respondent to register the petitioner's complaint dated 04.08.2022 to comply with the order in Crl.M.P.No.168 of 2022 passed by the Special Court for Land Grabbing, Trichirappalli dated 27.01.2023 within stipulated period.

ORDER

This criminal original petition has been filed to direct the third respondent to register the petitioner's complaint dated 4.08.2022 to comply with the order in Crl.M.P.No.168 of 2022 passed by the Special Court for Land Grabbing, Trichirappalli dated 27.01.2023 within stipulated period.

2. The learned counsel for the petitioner submitted that the petitioner gave complaint to the third respondent on 04.08.2022 against the private respondents and the same was not considered by the third 2/5

respondent. Therefore, the petitioner filed a complaint before the Special Court for Exclusive Trial of Land Grabbing Court for Exclusive Trial of Land Grabbing Cases, Trichirappalli and the same was allowed on 27.01.2023 with a direction to the third respondent to conduct enquiry and register the FIR. After lapse of three months, the third respondent has not registered the FIR, hence he filed the present petition.

3. The learned Additional Public Prosecutor appearing for the respondents 1 to 4 submitted that as per the order passed in Crl.M.P.No. 168 of 2022, enquiry is going on and within a period of 10 days, the entire enquiry will be completed.

4. In view of the above submission, this Court directs the second respondent to complete the enquiry within a period of ten days from the date of receipt of a copy of this order. Depending upon the outcome of the enquiry, the second respondent shall take further action and if the petitioner is aggrieved by the outcome of the enquiry, he can workout his remedy through appropriate proceedings.

5. With the above directions, this Criminal Original Petition is disposed of.
