PRAYER: Criminal Original Petition is filed under Section 528 of BNSS Act, 2023, to direct the learned Judicial Magistrate No.I, Sivagangai, to expedite the trial in C.C.No.359 of 2024 and complete the trial within time frame that may be stipulated by this Court.

ORDER

The present petition has been filed by the complainant in C.C.No.359 of 2024, on the file of the learned Judicial Magistrate No.I, Sivagangai, seeking expeditious disposal of the criminal proceedings.

2. According to the learned Counsel appearing for the petitioner, the accused was absent on several occasions and NBW was issued as against him on 12.02.2026. The accused person has voluntarily surrendered and recall petition was also allowed on 19.03.2026. According to the petitioner, he is aged about 77 years and therefore, he seeks for expeditious disposal of the criminal case.

3. Considering the fact that the complaint has been lodged under Section 138 of the Negotiable Instruments Act, the learned Judicial Magistrate No.I, Sivagangai, is directed to dispose of the proceedings in C.C.No.359 of 2024 on or before 31.08.2026.

4. With the above said observations, this Criminal Original Petition stands disposed of.
