Prayer : Criminal Original Petition filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, to direct the 3rd respondent to provide adequate police protection to the life and limb of the petitioner from the respondents 4 to 11.

ORDER

This petition has been filed by the petitioner to direct the 3rd respondent to provide adequate police protection to the life and limb of the petitioner from the respondents 4 to 11.

2. According to the petitioner, he is the owner of the properties in S.F.No.135/10A and other survey numbers situated at Kottainatham Revenue Village, Virudhunagar Taluk. While so, the private respondents no.4 to 11 have created forged documents by impersonation and registered the fraudulent documents. When the same was questioned by the petitioner, since 20.08.02022 till date, they were attempting to kidnap the petitioner and caused criminal intimidation and thereby, he lodged a complaint to the respondents no.1 to 3 on 20.03.2025, but no action was taken. Therefore, he has filed this petition.

The learned Government Advocate (Criminal Side) appearing for the respondents no.1 to 3 would submit that petitioner sent a representation on 20.03.2025 and they received the same yesterday i.e on 26.03.2025. If the petitioner appears along with the materials, then they will consider the representation of the petitioner and dispose of the same in accordance with law.

4. Considering the prayer sought for in the petition, this Court without even issuing notice to the respondents no.4 to 11 inclined to pass orders.

5. According to the petitioner, there is a life threat to the petitioner and thereby, he sent a representation to the respondents no.1 to 3, but the same has not been considered. According to the respondents no.1 to 3, yesterday only they received the representation of the petitioner and no any documents produced by him. Therefore, it is for the petitioner to produce the available documents with him before the 3rd respondent and thereafter, the 3rd respondent has to take appropriate action. In view of the same, this Court directs the petitioner to appear before the 3rd respondent on 05.04.2025 and produce all the documents available with him. Thereafter, the 3rd respondent has to conduct enquiry and dispose of the representation 3/6

of the petitioner dated 20.03.2025 after affording an opportunity to both the parties within a period of fifteen [15] days.

6. With the above said observations and directions, this Criminal Original Petition is disposed of.
