IN CRIME NO.4 OF 2018 ... RESPONDENT/ COMPLAINANT Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased to amend the petition and order copy as Crime No. 4 of 2017 instead of Crime No. 4 of 2018 and offence under section 406 IPC and section 4 of DP Act instead of Section 4 of DP Act in Crl.OP(MD)No. 8510/2018 dated 17.05.2018.

Order: This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of Mr.R.SELVARAJ, Advocate for the petitioner and of Mr.A.ROBINSON, Government Advocate (Crl.Side) on behalf of the Respondents the court made the following order:- The petitioner had earlier filed Crl OP(MD)No.6939 of 2018. When the matter came up before me, I adjourned the case to enable the petitioners to return sridhana articles. But, the petitioners made it clear that they have not such intention to return. In view of the conduct of the petitioners and taking note of the serious allegations made against them, I dismissed their anticipatory bail https://hcservices.ecourts.gov.in/hcservices/ petition on 28.04.2018.

2.But, the petitioners moved the Vacation Court and got anticipatory bail on 17.05.2018. But, as fate would have it, the petitioners had mentioned the crime number wrongly. Therefore, modification petition came to be filed. But, the vacation is over and the modification petition has been listed before me. 3.I am of the view that the petitioners have abused the process of this Court by moving the Vacation Court. Therefore, I do not want to show any indulgence to the petitioners. This Miscellaneous Petition stands dismissed.
