PRAYER: Contempt Petition filed under Section 11 of the Contempt of Courts Act, 1971 to punish the contemnor/2nd respondent for his willful and deliberate disobedience of the order of this Court passed in W.P.(MD)No.1437 of 2021 dated 26.10.2022.

ORDER

(Order of the Court was made by S.M.SUBRAMANIAM, J.) This contempt petition has been filed alleging disobedience of the order dated 26.10.2022 passed in W.P.(MD)No.1437 of 2021. 2.The learned Government Advocate appearing on behalf of the respondent, on instructions made a submission that the encroachments were already removed as per the directions of this Court. 3.The learned counsel appearing on behalf of the contempt petitioner raised an objection by stating that the fencing portion is yet to be removed. 4.However, the photographs produced by the Government Advocate reveals that the encroachment were already removed as directed by this Court and there is no disobedience of the order of this Court. 2/4

5.In view of the same, this contempt petition stands closed. However, if at all any portion of encroachment is left out, the same is also directed to be removed by the authorities.
