This criminal original petition has been filed, invoking Section 482 Cr.P.C. seeking orders to transfer the investigation in Crime No.118 of 2019 pending on the file of the fourth respondent to 1/3
the fifth respondent based on the representation made by the petitioner dated 24.04.2019.
2.The learned Government Advocate (Criminal Side) would submit that the fourth respondent police has filed the final report under Section 173 Cr.P.C. for the offences under Sections 304(2) and 294 (b) IPC and also filed the copy of the final report. 3.The learned counsel for the petitioner would submit that the submission made by the learned Government Advocate (Criminal Side) may be recorded and the petitioner may be given liberty to seek further appropriate relief. Since the fourth respondent has laid the final report for the offences under Sections 304(2) and 294(b) IPC, at this juncture, transfer of investigation does not arise at all. 4.Recording the submission made by both the learned counsels, this criminal original petition is dismissed and the petitioner is at liberty to approach the concerned forum for appropriate relief.
