O R D E R
This petition is filed by the petitioner to direct the respondents 1 and 2 to consider the petitioner's representations, dated 11.07.2024 and on 06.03.2025 and to take appropriate action against the third respondent within stipulated time.
2. The learned counsel for the petitioner would submit that the third respondent already borrowed money from the petitioner and thereafter, he has not repaid the money, thereby, the petitioner sent representations to the respondents 1 and 2 and the same have not be considered. Hence, he filed this petition.
3. The learned Additional Public Prosecutor (Crl side) for the respondents 1 and 2 would submit that the petitioner lodged a complaint as against the third respondent for money dispute, but no document was produced by the petitioner and also he did not co-operate with the enquiry. Page No. 2 of 5
If he produces any documents, they will consider the representations and take appropriate action in accordance with law.
4. Considering the prayer sought for in this petition, this Court, without issuing notice to the third respondent, is inclined to pass order in this petition.
5. The petitioner's prayer is to consider the petitioner's representations. The second respondent also admitted the receipt of the representation of the petitioner. However, according to the second respondent, the petitioner did not co-operate with the enquiry and also he has not produced any documents. Hence, it is appropriate that the petitioner has to appear before the second respondent and produce all the documents.
6. Accordingly, the petitioner is directed to appear before the second respondent, along with documents on 05.04.2025 and thereafter, the second respondent, has to complete the enquiry within a period of one week in accordance with law. It is needless to mention that if the matter is civil in nature, then the second respondent has to follow the circular Page No. 3 of 5
issued by the D.G.P in this regard.
7. With the above said observations and directions, this Writ Petition is disposed of.
