ORDER
The above Criminal Original Petition has been filed seeking direction for withdrawal of the case in Crime No.100 of 2019, pending on the file of the second respondent and entrust the same to the third respondent for investigation of the case and file a final report before the Jurisdictional Magistrate within the time stipulated by this Court.
2. When the matter is taken up for hearing today, the learned counsel for the petitioner would submit that it would be suffice if the second respondent police is directed to file a final report within the time to be stipulated by this Court.
3. The second respondent has filed a status report in June 2019, stating that they have already examined seven witnesses and they are taking steps to secure the accused and after tracing the https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL.OP(MD)No.6610 of 2019 accused, the final report will be filed as early as possible. But, even after two years, they have not chosen to file the final report.
4. Considering the above facts and circumstances of the case and also considering the fact that the second respondent has already examined seven witnesses and taking note of the limited prayer now sought for by the petitioner, the second respondent is directed to file a final report within a period of six weeks from the date of receipt of a copy of this order.
5. With the above directions, this Criminal Original Petition is disposed of.
