ORDER

The Criminal Original Petition has been filed to direct the first respondent to execute the warrant issued by the learned Judicial Magistrate, Fast Track, Eraniel against the second respondent in STC No. 296 of 2018.

2. Today, when the matter is taken up for hearing, the learned Government Advocate (crl. side) appearing for respondent police submitted that based on a complaint lodged by the petitioner as against the second respondent for the offence under Section 138 of Negotiable Instruments Act and the same has been taken cognizance in STC No. 296 of 2018 on the file of the learned Judicial Magistrate, Fast Track Court, Eraniel and summons was issued summons second respondent. The said summons was returned as 'unclaimed' and as such Non-Bailable warrant was issued as against the second respondent and it is pending with the file of the first respondnet police.

3. Considering the facts and circumstances, the first respondent is directed to execute the Non-Bailable warrant issued as against the second respondent in STC No. 296 of 2018 on the file of the learned Judicial Magistrate, Fast Track Court, Eraniel, within a period of Four Weeks from the date of receipt of a copy of the https://hcservices.ecourts.gov.in/hcservices/ 1/2

order. The petitioner is directed to co-operate with the respondent and furnish correct address of the second respondent to execute the Non-Bailable Warrant issued against the second respondent.

4. With the above directions, the Criminal Original Petition is disposed of.
