This Civil Miscellaneous Petition has been filed to restore the Second Appeal in S.A.(MD)No.467 of 2017, which was dismissed for non-prosecution on 20.03.2023 by this Court.

2. Heard the learned counsel appearing on either side, and I have perused the affidavit filed in support of this petition.

3. The learned counsel for the 1st respondent as well as the learned counsel for the 2nd respondent have not raised any objection to allow this petition.

4. The delay of 705 days in filing the present restoration petition was already condoned by this Court on 10.10.2025 in C.M.P.(MD) No.5461 of 2025 in S.A.(MD)No.467 of 2017.

5. Being satisfied with the reasons stated in the affidavit, and also considering the fact that this is only a consequential petition, this Civil Miscellaneous Petition is allowed.
